Receipt Of Proposals

Sealed proposals will be received at the office of the City Clerk, City Hall, 1327 Foothill Boulevard, La Cañada Flintridge, California 91011-2137, until 2:00 p.m. on Thursday, August 5, 2010, to perform all work required under the Owner’s Specifications

Opening Of Proposals

The proposals will be publicly opened and read at the time and date stated above, in the office of the City Clerk in said City Hall, and the results will thereafter be referred to the City Council for consideration at a subsequent meeting.

Scope Of Work

The work to be done consists of furnishing all labor, materials, equipment, tools, and incidentals as required by the Plans (Appendix G), Specifications, and Contract Documents. The general items of work consist of miscellaneous guardrail improvements at three (3) locations throughout the City which include retrofitting and/or new installation of metal beam guardrail and post, and miscellaneous appurtenant work. Clean up and leave in an operable and acceptable condition all of the work and other items not mentioned that are required by the Plans and Specifications.

Completion Of Work

he work shall commence within fifteen (15) calendar days after the date set forth in the “Notice to Proceed.” All work shall be completed within fifteen (15) working days from said date.

Plans And Specifications

Copies of the Plans and Specifications may be examined without charge at the Public Works Department in La Cañada Flintridge City Hall. Complete sets may be obtained from the Public Works Department at City Hall upon payment of a charge of $10.00 (non-refundable) for each set. A charge of $10.00 (non-refundable) will be made for mailing each set.

Construction and Demolition Recycling Requirement

The Contractor’s attention is directed to Appendices “B” and “C” for compliance. A minimum of fifty percent (50%) of the project’s waste including soil/dirt is required to be recycled, or reused. Prior to the start of work, the Contractor shall submit a performance security, calculated as the lesser of three percent (3%) of the project bid or $10,000 in a form acceptable to the City. Such performance security shall be forfeited to the City if the recycling requirements are not satisfied. Prior to the start of work, the Contractor shall obtain written authorization from the Engineer for: (i) proposed haul route (see Appendix “E”) and (ii) any proposed self hauling of materials. Any monitoring of the self hauling deemed necessary by the Engineer shall be at the sole expense (deposit may be required) of the Contractor.

Guarantee

Each bid shall be made on the proposal form furnished by the City and shall be in accordance with the Plans, Specifications, and Contract Documents and shall be accompanied by a certified check, cashier’s check, or bidder’s bond, payable to the City in a sum not less than ten percent (10%) of the amount of the bid, as a guarantee that the bidder will enter into the contract for the work, the full amount of such guarantee to be forfeited to the City should said bidder fail to enter into said Contract. The successful bidder will be required to furnish a Faithful Performance Bond in the amount of not less than one hundred percent (100%) of the contract price, and a Labor and Material Bond in an amount of not less than one hundred percent (100%) of the contract price, said bonds to be underwritten by sureties qualified to do business in the State of California, carrying a rating of A+ or better, in the current edition of Bests Insurance Guide.

Conflict of Interest

In the procurement of supplies, equipment, construction, and services by sub-recipients, the conflict of interest provisions in 24 CFR 85.36, OMB Circular A-110, and 24 CFR 570.611 shall apply. No employee, officer, or agent of the sub-recipient shall participate in the selection, award, or administration of a contract supported by federal funds if a conflict of interest, real or apparent, would be involved.

Prevailing Wage Rates

Any contract entered into pursuant to this notice will incorporate the provisions of the State Labor Code. Pursuant to the provisions of the California Labor Code Section 1773.2, the minimum prevailing rate of per diem wages for each craft, classification, or type of worker needed to execute the Contract shall be those determined by the Director of Industrial Relations of the State of California, which are on file in the Public Works Department at City Hall and are available to any interested party on request.

Labor Code

Attention is directed to the provisions of Sections 1777.5 and 1777.6 of the Labor Code, concerning the employment of apprentices by the Contractor or any subcontractor under him. The Contractor and any subcontractor under him shall comply with the requirements of said sections in the employment of apprentices.

Information relative to apprenticeship standards and administration of the apprenticeship program may be obtained from the Director of Industrial Relations, San Francisco, California, or the Division of Apprenticeship Standards and its branch offices.

Payment Retention

The Contractor may elect to receive 100 percent of the payments due under the contract without retention of any portion of the payment by the City, by depositing securities of equivalent value with the City in accordance with the provisions of Section 4590 of the Government Code. Said securities if deposited by the Contractor shall be valued by the City whose decision shall be final.

City Rights Reserved

The City reserves the right to reject any or all bids, to waive any informality in a bid, and to make awards in the interest of the City. No bidder may withdraw his bid for a period of thirty (30) days after the bid opening.
